Conditions of Participation

Registration and participation in the DE CAF-MAN Challenge is completely free. Registration limited to first 200 eligible applicants.
Participation is only open to residents of Europe and the UK with valid shipping addresses, not including P.O. Boxes
Swiss Water is not responsible for any customs, import or other fees that may be incurred as a result of this competition.
In order to be eligible to win the grand prize, you must have completed all of the challenges and uploaded your answers following the directions AND publicly posted about the challenge on A) your Instagram Feed and B) your Instagram Stories OR Reels. This must be viewable by the Swiss Water team when reviewing the results. If your Instagram account is private, you must allow Swiss Water to follow you in order to confirm your eligibility. No purchase necessary to win. Void where prohibited.
In the event of a tie, the tied competitor’s Instagram timeline posts will be evaluated by the judges and the Swiss Water Team for the most creative post about the experience. The post can be video, text based or just photos, but should convey something about yourself and your experience completing DE CAF-MAN.
The competition will be open from 11 April 2021 until 7 May 2021. If you have not submitted your answers by 7 May 2021, you will not be eligible to win the grand prize. You can, of course, play the game anytime!
Swiss Water does not take any responsibility for delays in shipping or issues uploading challenge answers.

Swiss Water reserves the right to change or update participations of condition of the DE CAF-MAN Challenge at any time. It is the responsibility of the participant to be compliant with the rules.
Social posts submitted by the participants as part of the DE CAF-MAN Challenge may not contain any content that:
a. is obscene, offensive, sexually explicit or suggestive; violent; derogatory of any ethnic, racial, gender, religious, professional or age group; endorses any form of hate or hate group; profane or pornographic; contains nudity; and/or is harmful to minors in any way;
b. promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
c. contains products or trademarks of any Sponsor competitor;
d. defames, misrepresents or contains disparaging remarks about any person or company;
e. contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission, to the extent permission is necessary; contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
f. infringes the copyright, trademark, patent, trade secret, publicity, or other intellectual property or proprietary rights of others or that is invasive of another person's privacy, without permission, to the extent permission is necessary;
g. contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission, to the extent permission is necessary;
h. contains look-alikes of celebrities or other public or private figures, living or dead;
i. communicates messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate; and/or
j. violates any law or regulation;
k. encourages conduct that may constitute or contribute to a criminal offense, give rise to civil liability or violate any national, international, state or local law, regulation or authority.
We do not assume any responsibility for the consequences of any DE CAF-MAN Challenge participant content. You agree to defend, indemnify and hold harmless us, our officers, directors, shareholders, employees, agents, licensors and suppliers from and against any and all claims, actions, demands, liens, allegations, damages of every kind and description, encumbrances, losses, costs, expenses, fines, liabilities and settlements, including without limitation reasonable legal and accounting fees, resulting from, or alleged to result from: (i) your content; (ii) your infringement or alleged infringement of the copyright, trademark, patent, publicity rights, or other proprietary rights of third parties or your breach or alleged breach of any representation, warranty, or covenant made by you in these Conditions of Participation.
EXCLUSION OF LIABILITY
By entering the DE CAF-MAN Challenge, each entrant (a) agrees to be bound by these Official Rules and the decisions of Sponsor or its designees, which shall be final and (b) agrees to release and to hold Swiss Water Decaffeinated Coffee Inc., and their respective parents, shareholders, directors, officers, employees, representatives, agents, affiliates, subsidiaries, and legal advisors, harmless against any and all claims, losses, rights, liabilities and damages, and actions of any kind arising out of their participation in the DE CAF-MAN Challenge and/or the acceptance and use of any Prize. The foregoing release includes, but is not limited to, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Under no circumstances shall any of the Swiss Water Decaffeinated Coffee Inc. have any liability or responsibility for: (1) incorrect or inaccurate entry information, or faulty, failed, garbled or jumbled electronic data transmissions; (2) any unauthorized access to or theft, destruction or alteration of entries at any point; (3) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the Giveaway; (4) inaccessibility or unavailability of the Internet or a Giveaway site or any combination thereof; (5) any injury or damage to a participant’s or to any other person's computer, tablet, mobile device or other electronic device that may be related to or result from any attempt to participate in the DE CAF-MAN Challenge or download any materials in the DE CAF-MAN Challenge; or (6) any typographical error or other error in these Official Rules or in any other communication relating to the DE CAF-MAN Challenge. All entries become the property of Swiss Water Decaffeinated Coffee Inc.
